En la Constitución de España en su título preliminar artículo 6 aclara.

Los partidos políticos expresan el pluralismo político, concurren a la formación y manifestación de la voluntad popular y son instrumento fundamental para la participación política. Su creación y el ejercicio de su actividad son libres dentro del respeto a la Constitución y a la ley. Su estructura interna y funcionamiento deberán ser democráticos.

Se presenta en el capítulo segundo de Derechos y libertades, sección primera aclara en su artículo 23 lo siguiente.

1. Los ciudadanos tienen el derecho a participar en los asuntos públicos, directamente o por medio de representantes, libremente elegidos en elecciones periódicas por sufragio universal.

2. Asimismo, tienen derecho a acceder en condiciones de igualdad a las funciones y cargos públicos, con los requisitos que señalen las leyes.

Political participation from the Constitution of Spain

In the Constitution of Spain in its preliminary title Article 6 clarifies.

Political parties express political pluralism, concur to the formation and manifestation of popular will and are a fundamental instrument for political participation. Its creation and the exercise of its activity are free within the respect of the Constitution and the law. Its internal structure and functioning must be democratic.

It is presented in the second chapter of Rights and Freedoms, section one clarifies in its article 23 the following.

1. Citizens have the right to participate in public affairs, directly or through representatives, freely elected in periodic elections by universal suffrage.

2. Likewise, they have the right to access, in conditions of equality, public functions and positions, with the requirements stipulated by law.
