El elemento del temor es entendido por el Manual de Procedimientos y Criterios delAlto Comisionado de las Naciones Unidas para los Refugiados (ACNUR) para la Determinación de la Condición de Refugiado, el principal instrumento autorizado de interpretación de los tratados en la materia, como el elemento subjetivo de este requisito e integrante central de la razón por la cual se otorga la protección. En este sentido el temor se manifiesta como “estado de ánimo y condición subjetiva” y podría ser entendido como cualquier expresión emocional que denote falta de seguridad sobre una determinada situación, en este caso, el albergarse dudas sobre la integridad física, emocional, mental o psicológica propia al evento de someterse a la protección, o ausencia de esta, que brinda un determinado Estado.
